Terms & Conditions

These are the rules for using Embr. We kept them as human as legal terms get. By creating an account or using the app, you're agreeing to them — so it's worth a scroll.
The short version
- Be 16+ to use Embr, 18+ for Orbit. Be decent to people.
- Embr's in-app ephemerality is a design choice — not a cryptographic guarantee. Content is processed server-side so we can deliver it, keep the platform safe, and meet applicable legal obligations. Retention windows, permitted uses, and the (narrow) circumstances in which we may preserve or disclose data are set out in Section 05 and Section 06.
- Don't harass, threaten, spam, or post anything illegal. We'll remove you if you do — and we cooperate with law enforcement in serious cases.
- Lose your password and your account is gone for good — we can't recover it.
- The app is provided “as is”. Use it sensibly.
01Accepting these terms
Embr (the “Service”) is operated by Foxcyber Solutions Private Limited (“Foxcyber Solutions”, “we”, “us”, “our”). By downloading, creating an account on, or using Embr, you agree to these Terms & Conditions and to our Privacy Policy. If you don't agree, please don't use Embr.
02Who can use Embr
You must be at least 16 years old (or the minimum age of digital consent where you live) to use Embr, and at least 18 to use Orbit's stranger-matching features. By using the Service you confirm you meet these requirements and that you can form a binding contract. Embr is for personal, non-commercial use.
03Your account & your key
- You choose a unique userid and a password. You're responsible for keeping your password safe and for everything that happens under your account.
- We cannot reset or recover your password. If you lose it, you lose access to the account permanently. This is a deliberate security choice — save your key somewhere safe.
- Don't impersonate others, sell or transfer your account, or use someone else's.
04Community rules
Embr only works if people feel safe. You agree not to:
- Harass, bully, threaten, stalk, or intimidate anyone.
- Share sexual content involving minors, or sexualise, groom, or endanger anyone underage — zero tolerance, reported to authorities.
- Post content that is illegal, hateful, violent, or incites harm.
- Share someone's private information without consent, or attempt to identify, track, or de-anonymise other users.
- Spam, scam, phish, or send unsolicited promotions.
- Attempt to capture, archive, or extract content that's meant to disappear, or circumvent the app's ephemerality, security, or rate limits.
- Reverse-engineer, scrape, or disrupt the Service or its infrastructure.
We may remove content and suspend or terminate accounts that break these rules.
05Ephemerality, processing & server-side retention
Embr's "disappearing" behaviour is a user-experience design intended to reduce the persistence of conversations within the app. It is a UX property, not a cryptographic assertion. By using the Service you acknowledge and agree that:
- In-app ephemerality is not a technical guarantee of non-persistence. The design controls how content is displayed to you and other recipients within the Embr application. It does not represent that no copy exists, that no processing occurs, or that no server-side record is created during delivery.
- Server-side processing is necessary to operate the Service. To transmit messages, enable core features (including Orbit, Open Circles, and status / "glimmer" posts), maintain platform integrity, prevent abuse, and comply with legal obligations, content transiting the Service is processed and, where required for those purposes, stored on infrastructure under our control. Content stored server-side is protected by encryption at rest. Embr is not end-to-end encrypted; the Service is capable of accessing content it processes.
- Retention is limited to what is necessary. We retain content only for as long as reasonably required to fulfil the operational, safety, and compliance purposes described in our Privacy Policy. Content that has fulfilled its operational purpose is scheduled for removal in the ordinary course.
- Preservation and disclosure on a lawful basis. We may retain, preserve, restore, or disclose specific data — including message content that would otherwise be removed — where we are required to do so by a binding legal instrument (such as a subpoena, court order, search warrant, or production demand issued under applicable law), or where we form a good-faith belief that such action is necessary to investigate or prevent serious harm, abuse of a minor, fraud, terrorism, threats to life or safety, or a material violation of these Terms. See Section 06.
- Recipient behaviour is outside our control. Recipients can remember, transcribe, paraphrase, or capture content using external devices or third-party tools. We discourage such conduct and may deploy deterrents; we cannot physically prevent it.
- User discretion. Embr is not intended as a system of record. You should not use the Service to store material you need to retain, and you should not transmit material through the Service that you would not be comfortable seeing preserved or disclosed in the limited circumstances set out above.
06Law enforcement, legal requests & safety
We cooperate with law enforcement, courts, and regulators where the law requires it. Specifically:
- We respond to valid, binding legal requests — including subpoenas, court orders, search warrants, production orders, and other formal demands — issued under applicable law. Where local law requires, we may also preserve specific data pending such requests.
- We may disclose information about you (including account data, device and connection metadata, and the contents of messages or posts stored on our servers) when we have a good-faith belief that disclosure is reasonably necessary to: comply with a legal obligation; protect the safety of any person; investigate or prevent fraud, abuse of children, terrorism, threats of violence, or other illegal activity; or enforce these Terms and our policies.
- Where the law permits and it is not contrary to a legal restriction, we may notify affected users about legal requests.
- Nothing in Embr's marketing or design (including phrases like “built to forget” or “disappearing”) limits these rights, our legal duties, or the responsibilities of users.
07Orbit & Open Circles
Orbit may connect you with people you don't know, and Circles are shared spaces. Use common sense: don't share identifying or financial information with strangers, and report anything that feels off. You interact with other users at your own risk. Embr doesn't conduct background checks and isn't responsible for the conduct of other users, online or off.
08Your content
You own what you create. You grant Foxcyber Solutions a limited, worldwide, royalty-free licence to host, store, transmit, display, and process your content solely to operate the Service (including delivery to recipients, safety review, abuse investigation, and compliance with law) — and only for as long as we hold the content. We don't claim ownership and we don't use your private content for advertising.
09Suspension & termination
You can delete your account anytime via Delete account. We may suspend or terminate your access if you break these Terms, create risk for others, or where required by law. Because of how deletion works, terminated accounts and their data cannot be restored — except for limited records we are required to keep for legal, safety, or regulatory purposes.
10Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, or that the Service will be uninterrupted, secure, or error-free, to the fullest extent permitted by law. We make no warranty that any specific message will be delivered, will remain hidden, will disappear at any particular time, or will be preserved.
11Limitation of liability
To the maximum extent permitted by law, Foxcyber Solutions and its team are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, content, or messages (including content that fails to send, sends, disappears, fails to disappear, or is preserved or disclosed under Sections 05 and 06), arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
12Changes
We may update these Terms. We'll revise the date above and, for material changes, notify you in the app. Continuing to use Embr after changes take effect means you accept them.
13Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Disputes will be subject to the exclusive jurisdiction of the competent courts in India, unless mandatory local consumer law gives you other rights. These Terms are a plain-language document. It is not, and is not a substitute for, legal advice for any particular dispute. Foxcyber Solutions Private Limited may update this page; the current version is the one that applies.
